Federal Judge Blocks ACA Coverage for DACA Recipients

He rules that a CMS final rule cannot redefine “lawfully present.”

U.S. District Court Judge Daniel Traynor granted 19 states a stay from allowing Deferred Action for Childhood Arrivals (DACA) recipients to enroll in the Affordable Care Act (ACA). The Centers for Medicare and Medicaid Services had announced a final rule permitting so-called “Dreamers,” who entered the United States illegally as children, to enroll in Obamacare health plans and apply for other assistance.

Judge Traynor ruled, “The authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term ‘lawfully present.‘” 

President-elect Trump and his border czar Tom Homan have indicated being open to legislative solutions for the DACA recipients to become legal in exchange for support on border security and deportation.
